This website, BrainPit.com, is operated by MWG Investments, LLC, a Florida limited liability company (“BrainPit,” “we,” “us,” or “our“). By visiting our site, creating an account, or purchasing anything from us, you agree to these Terms of Service (“Terms“) and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the site.

These Terms apply to everyone who uses the site, whether as a visitor, free member, paid member, or customer. We may update these Terms at any time by posting the revised version here; the “Last updated” date will change when we do. Continued use after a change means you accept it.

1. MEMBERSHIP TERMS

Eligibility. You must be 18 or older to create an account or purchase a membership. By registering, you confirm that you are.

Plans. BrainPit offers a Free membership and paid Standard and Premium memberships. Plans differ by which tools you can access. Current pricing and tool access are shown on the site at the time of purchase and may change with notice. Changes to pricing do not affect a billing period you have already paid for.

Daily usage limit. Every membership, free or paid, includes up to 100 tool queries per day. A query is one message sent to a tool. The count resets daily. This limit keeps the service fast and affordable for everyone; we may adjust it and will post any change here.

Billing and renewal. Paid memberships are billed in advance, automatically, on a recurring basis through our payment processor (Stripe). By purchasing, you authorize us to charge your payment method each billing period until you cancel. If a payment fails, we may retry it and may suspend paid access until it succeeds. You are responsible for keeping your payment information current.

Cancellation. You can cancel anytime from your account page. Cancellation stops future charges; you keep paid access through the end of the period you have already paid for. We do not prorate partial periods.

Refunds. You may request a full refund of your first payment within 7 days of that payment. No other payments, including renewals, are refundable.

Gift memberships. If we offer gift memberships, the purchaser is responsible for payment and the recipient is bound by these Terms when they activate the gift. Gift purchases are subject to the same 7-day refund rule, measured from the purchase date, and are not refundable once redeemed.

Fair use. Memberships are for one person. Sharing logins, automating requests, scraping, or using the tools to build a competing service is not allowed and may result in suspension without refund.

Account security. You are responsible for keeping your password private and for all activity under your account. Tell us right away if you believe your account has been accessed without permission.

Termination. We may suspend or close accounts that violate these Terms, abuse the tools, or attempt to circumvent limits. You may close your account at any time by contacting us.

2. CALLS, WORKSHOPS & OTHER SERVICES

From time to time we may offer services such as one-on-one setup or coaching calls, live group workshops, or custom AI tool builds. Unless the offer page says otherwise:

  • Scheduled calls and workshops may be rescheduled or cancelled for a full refund up to 24 hours before the start time. Missed appointments and cancellations within 24 hours are not refundable. If we must cancel, you may choose a new time or a full refund.
  • Recordings. Workshops may be recorded. By attending you consent to being recorded and to our use of the recording, including for promotional purposes. You may keep your camera off if you prefer not to appear.
  • Custom builds and other project work are governed by the description and price on the order page. Setup fees are earned when the work is delivered and are not refundable after delivery. Any recurring hosting or maintenance fee follows the membership billing and cancellation rules above.
  • Services are educational and informational. They are not professional advice, and results depend on how you apply what you learn.

3. DIGITAL PRODUCTS

Digital products are items you download, such as PDFs, guides, templates, worksheets, and similar files. They are delivered immediately after successful payment through a link in your emailed receipt and on your account page. There is no physical shipment.

Because digital products cannot be returned, refunds are available only within 3 days of purchase and only if the file is defective or materially different from its description. No exchanges. Digital products are licensed for your personal use and may not be resold, redistributed, or shared.

4. PHYSICAL PRODUCTS

Physical products (such as apparel, mugs, and similar merchandise) are made to order by a print-on-demand partner. Please allow 2 to 7 business days for production, plus 2 to 5 business days for delivery within the continental United States, and longer during holiday periods.

Order changes. Made-to-order items go into production quickly. Contact us within 24 hours of ordering if your address or order details are wrong; after production begins we usually cannot change or cancel an order.

Shipping. Shipping costs and options are shown at checkout. We ship within the United States by default; contact us before ordering if you are elsewhere.

Returns. If an item arrives damaged, defective, or wrong, contact us within 14 days of delivery with photos and we will replace it or refund it. Because items are made to order, we do not accept returns for size, fit, or change of mind. Personalized or customized items are not returnable except for defects.

5. AI TOOLS DISCLAIMER

Use at your own risk. BrainPit provides AI-powered tools for informational, educational, and entertainment purposes. AI systems can produce output that is inaccurate, incomplete, outdated, or wrong, and they can do so confidently. You are solely responsible for reviewing and verifying any AI-generated output before relying on it for personal, financial, legal, medical, safety, or business decisions.

Not professional advice. Nothing produced by a BrainPit tool is legal, financial, medical, tax, or other professional advice, and using our tools does not create a professional relationship of any kind. Tools that address scams, health, money, benefits, or similar topics are aids to your own judgment, not substitutes for it.

How your inputs are handled. What you enter into a tool is sent to a third-party AI provider to generate the response. Do not enter passwords, full financial account numbers, Social Security numbers, or other information you would not want a third party to see. See our Privacy Policy for details.

No guarantees. We make no warranty that any AI-generated output is accurate, original, complete, or fit for a particular purpose. “Quality” is subjective and varies by the person using the result; we offer no guarantee of quality.

Limitation of liability. To the fullest extent permitted by law, BrainPit and its owner, affiliates, partners, and contractors are not liable for any damages, losses, or claims, direct or indirect, arising from the use or misuse of any content produced by our tools.

6. INTELLECTUAL PROPERTY & COPYRIGHT

Your inputs and outputs. You are responsible for what you enter into BrainPit tools and for how you use what comes out. Any content you create, publish, or reuse with our tools is your responsibility, including making sure it does not infringe anyone’s copyright, trademark, or other rights.

No monitoring. BrainPit does not review AI-generated output for originality, legality, or appropriateness and makes no warranty about it. You agree that BrainPit is not liable for any claim arising from alleged or actual infringement, plagiarism, or misuse of intellectual property connected to output from our tools.

Best practice. Review and, where needed, edit AI-generated content before using it publicly or commercially.

Our property. The BrainPit name, logo, site design, tool configurations, the instructions behind each tool, and our digital and physical products belong to BrainPit and are protected by copyright and trademark law. You may not copy, resell, scrape, or reverse-engineer them without our written permission.

7. GENERAL TERMS

7.1 Acceptable use. You may not use the site or its content: for any unlawful purpose; to violate any law or regulation; to infringe our intellectual property rights or anyone else’s; to harass, abuse, threaten, defame, or discriminate against anyone; to submit false or misleading information; to upload viruses or malicious code; to collect or track the personal information of others; to spam, phish, spider, crawl, or scrape; or to interfere with or circumvent the security or usage limits of the site. We may terminate your access for any of these.

7.2 Accuracy of information. Material on this site is provided for general information. We do not guarantee that it is accurate, complete, or current, and it should not be your sole basis for a decision. We may change the site’s content at any time and are not obligated to update any information.

7.3 Changes to the service and prices. Prices are subject to change. We may modify or discontinue the site or any part of it at any time without notice, and are not liable to you or any third party for doing so. Changes do not affect a membership period you have already paid for.

7.4 Orders and billing. We may refuse or cancel any order, and may limit quantities per person, household, or order, including orders that appear to come from resellers. You agree to provide current, complete, and accurate account and payment information and to keep it updated. For PCI and security reasons, we do not store your full card number on our servers; payments are handled by Stripe.

7.5 Third-party tools and links. The site may provide access to third-party tools and links to third-party sites we do not control. We provide such access “as is,” without warranty or endorsement, and are not responsible for third-party content, products, services, or practices. Review their terms before using them.

7.6 Feedback and submissions. If you send us ideas, suggestions, reviews, testimonials, or other material, you agree that we may use, edit, and publish it in any medium without restriction or compensation, and that we have no obligation to keep it confidential or respond to it. You are responsible for anything you submit and agree it will not violate anyone’s rights or contain unlawful or malicious content. You may not impersonate anyone or misrepresent the origin of a submission.

7.7 Errors and omissions. The site may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, offers, or availability. We may correct them and may cancel orders affected by an error at any time, including after an order has been placed.

7.8 Disclaimer of warranties. Your use of the site is at your sole risk. The site, the tools, and everything provided through them are offered “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free, or that results obtained from it will be accurate or reliable. We may remove or suspend the service at any time without notice.

7.9 Limitation of liability. To the fullest extent permitted by law, MWG Investments, LLC, BrainPit.com, and our owners, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors are not liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from your use of the site, the tools, or any product or service obtained through them, even if advised of the possibility of such damages. Where the law does not allow this exclusion, our liability is limited to the maximum extent permitted, and in any event to the amount you paid us in the twelve (12) months before the claim arose.

7.10 Indemnification. You agree to indemnify, defend, and hold harmless MWG Investments, LLC, BrainPit.com, and our owners, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors from any claim or demand, including reasonable attorneys’ fees, made by any third party arising from your breach of these Terms, your use of the site or tools, or your violation of any law or the rights of a third party.

7.11 Severability. If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted and the remaining provisions will stay in effect.

7.12 Termination. These Terms remain in effect until terminated by you or us. You may terminate by closing your account or ceasing to use the site. We may terminate or suspend your access at any time without notice if we believe you have violated these Terms; you remain liable for amounts due through the termination date. Obligations that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive.

7.13 Entire agreement; no waiver. These Terms, together with the Privacy Policy and any policies posted on the site, are the entire agreement between you and us regarding the site and supersede any prior agreements. Our failure to enforce any provision is not a waiver of it. Ambiguities will not be construed against the drafting party.

7.14 Governing law and venue. These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.
