1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In short: We collect personal information that you provide to us.

We collect personal information you voluntarily provide when you register, purchase a membership, use our AI tools, subscribe to our emails, contact support, or otherwise interact with us. Depending on what you do, this may include:

  • Email address
  • Name (if you provide it)
  • Username and password (passwords are stored in hashed form; we cannot read them)
  • Billing name and billing address for paid memberships
  • The text, files, or images you enter into our AI tools
  • Communication and marketing preferences

Payment information. Payments are processed by Stripe. We do not store your full card number. Stripe’s handling of your data is governed by its own privacy policy at https://stripe.com/privacy.

Sensitive information. We do not intentionally collect sensitive personal information (such as health, financial account, or government ID information). Please do not enter it into our AI tools.

All personal information you provide must be true, complete, and accurate, and you must notify us of any changes.

Information automatically collected

In short: Some information, such as your IP address and browser or device characteristics, is collected automatically when you visit our Services.

We automatically collect certain information when you visit or use the Services. This information does not reveal your specific identity but may include:

  • Log and usage data: IP address, browser type and settings, pages viewed, date and time stamps, referring URLs, actions you take on the site, and error reports.
  • Device data: device type, operating system, browser, and general location derived from your IP address.
  • AI tool usage: which tools you use, how often, and the number of queries you send, so we can enforce daily limits, prevent abuse, and improve the Services.

Information collected from other sources

In short: We may receive limited information from service providers and marketing partners.

We may receive information about you from our payment processor (transaction status), our email platform (delivery and engagement data), and analytics or advertising partners (aggregated campaign performance). We use this to run the Services, understand how our marketing performs, and keep our records accurate.

  • Deliver AI tool responses, which requires sending your inputs to our AI providers (see Section 7).
  • Process payments and manage subscriptions, including renewals, failed-payment retries, and cancellations.
  • Enforce usage limits and prevent abuse, such as daily query limits and account sharing.
  • Send service messages, such as account confirmations, billing notices, and important changes to our terms.
  • Send marketing emails about new tools, tips, and offers, which you can opt out of at any time.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In short: With service providers who help us run BrainPit, and in limited legal or business-transfer situations. We do not sell your personal information.

  • AI providers. The content you submit to our AI tools is sent to third-party AI providers, currently OpenAI and Anthropic, solely to generate a response. See Section 7.
  • Payment processing. Stripe processes payments for paid memberships.
  • Email delivery. Our email platform sends account, service, and marketing emails on our behalf.
  • Hosting and security. Our hosting provider and content delivery / security services (such as Cloudflare) process traffic to keep the site running and secure.
  • Analytics and advertising. Google Analytics, Google Tag Manager, Meta (Facebook) Pixel, and Pinterest Tag help us measure site usage and advertising performance. See Cookie Policy.
  • Business transfers. In connection with a merger, sale of assets, financing, or acquisition of all or part of our business.
  • Legal requirements. Where required by law, subpoena, or court order, or to protect our rights, safety, or property.

Our service providers are permitted to use your information only to perform services for us and are required to protect it.

5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In short: We are not responsible for information you share with third parties we link to.

The Services may link to third-party websites, services, or applications, including affiliate links. We do not control and are not responsible for the content, privacy practices, or security of any third party. A link does not imply endorsement. Review the policies of any third party before providing them with your information.

6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We use cookies and similar technologies (web beacons, pixels, tags) to keep you logged in, remember preferences, keep the site secure, understand how it is used, and measure advertising. Third parties, including Google, Meta, and Pinterest, may set cookies through our site for analytics and advertising. To the extent these technologies are considered a “sale” or “sharing” under US state privacy laws, you can opt out as described in Section 13.

7. HOW DO OUR AI TOOLS HANDLE YOUR INFORMATION?

In short: What you type into a tool is sent to an AI provider to generate the answer. Don’t enter anything you wouldn’t want a third party to see.

When you use a BrainPit AI tool, the text you enter, along with any files or images you upload, is transmitted to a third-party AI provider (currently OpenAI or Anthropic, depending on the tool) to generate a response. Those providers process your input under their own terms and privacy policies:

We use these providers’ business/API services, which by their published terms do not use API inputs to train their models. We cannot control changes to their policies.

Please do not enter passwords, full credit card or bank account numbers, Social Security numbers, medical record numbers, or other information you would not want shared with a third party.

Usage logs. We keep a record of tool usage (which tool, when, and the query content) for a limited period to provide support, enforce daily limits, prevent abuse, and improve the tools. Some tools may save your past conversations to your account so you can return to them; you can delete these from within the tool.

Personalization. Some tools may use information you have provided in your account or in earlier conversations to make responses more relevant to you. We do not use this information for any other purpose without your consent.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

In short: As long as necessary for the purposes in this notice, unless the law requires longer.

We keep your account information for as long as your account is active. Tool usage logs are kept for a limited period and then deleted or anonymized. After you close your account, we delete or anonymize your personal information within fourteen (14) months, except where we must keep it longer for tax, accounting, fraud prevention, or legal requirements, or where it is held in backup archives pending routine deletion.

9. HOW DO WE KEEP YOUR INFORMATION SAFE?

In short: We use reasonable technical and organizational safeguards, but no system is 100% secure.

We use HTTPS encryption for all traffic, store data on private servers with access controls, use security monitoring and firewall protection, and limit access to personal information to what is needed to run the Services. However, no transmission over the Internet or electronic storage is completely secure, and we cannot guarantee that unauthorized parties will never defeat our safeguards. Use the Services only within a secure environment and keep your password private.

10. DO WE COLLECT INFORMATION FROM MINORS?

In short: No. You must be 18 or older to use BrainPit.

We do not knowingly collect data from or market to anyone under 18. By using the Services, you represent that you are at least 18. If we learn that we have collected personal information from someone under 18, we will deactivate the account and delete the data. 11. WHAT ARE YOUR PRIVACY RIGHTS?

In short: Depending on where you live, you may have rights to access, correct, delete, or restrict use of your personal information. You can review, change, or close your account at any time.

In some regions (such as the EEA, UK, Switzerland, Canada, and certain US states), you have rights under applicable data protection law. These may include the right to (i) access and obtain a copy of your personal information, (ii) request correction or deletion, (iii) restrict processing, (iv) data portability, and (v) not be subject to automated decision-making. If you are in the EEA or UK and believe we are processing your information unlawfully, you may complain to your Member State data protection authority or the UK Information Commissioner’s Office. If you are in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent. Where we rely on your consent, you can withdraw it at any time by contacting us or updating your preferences. Withdrawal does not affect processing that already took place.

Opting out of marketing emails. Click the unsubscribe link in any marketing email, or contact us. You will still receive service messages needed to run your account (such as billing notices and confirmations).

Account information. You can review or update your account information by logging in to your account page. To close your account, contact us. We will deactivate or delete your account and information from our active databases, but may retain some information to prevent fraud, troubleshoot problems, enforce our terms, or comply with law.

Cookies. Most browsers accept cookies by default. You can set your browser to reject or remove cookies, though some features may not work. You can also opt out of interest-based advertising at aboutads.info/choices.

12. CONTROLS FOR DO-NOT-TRACK FEATURES

Most browsers include a Do-Not-Track (“DNT”) setting. No uniform standard for honoring DNT signals has been adopted, so we do not currently respond to DNT signals or similar mechanisms. If a standard we must follow is adopted in the future, we will update this notice. California law requires us to state how we respond to DNT signals: because there is no industry or legal standard, we do not respond to them at this time.

13. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In short: If you live in a US state with a comprehensive privacy law (including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia), you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain processing.

We may also collect other personal information when you contact support, take part in surveys or contests, or otherwise interact with us. We retain each category as described in Section 8.

We have not sold personal information in the preceding twelve (12) months and will not sell it. We may “share” information with advertising partners through cookies and pixels for targeted advertising as defined under California law; you can opt out as described below.

Your rights. Subject to applicable law, you may have the right to: know whether we process your personal data; access it; correct inaccuracies; request deletion; obtain a copy; not be discriminated against for exercising your rights; and opt out of targeted advertising, sale of personal data, or profiling that produces legal or similarly significant effects. Depending on your state, you may also have the right to obtain a list of third parties to whom we have disclosed personal data, and to limit the use of sensitive personal data.

Verification. We will verify your identity before acting on a request, using information we already hold. We may ask for additional information for verification or fraud-prevention purposes.

Appeals. If we decline your request, you may appeal by contacting us at https://brainpit.com/contact-us/ with “Privacy Appeal” in your message. We will respond in writing. If your appeal is denied, you may complain to your state attorney general.

Financial incentives. We may offer discounts, referral rewards, or loyalty programs in exchange for information such as your email address. If we do, we will explain the material terms at the time and you may withdraw at any time by contacting us. Under California law, the value of your information is related to the value of the benefit provided, less our cost of providing it.

California “Shine the Light.” California residents may request, once a year and free of charge, information about personal information (if any) we disclosed to third parties for their direct marketing purposes. Submit requests through our contact page.
